Spry provides an intercollegiate athletics management platform (the “Platform”) and related tools and services, including, but not limited to the Spry mobile app (the “App”) (collectively, the “Services”) designed to enable collegiate administrators (“Collegiate Administrators”) to manage the college facilities, paperwork, documents, and student athletes (“Student Athletes”) rosters, as well as send in Platform messages, and recruit potential Student Athletes.
This Privacy Policy sets out how we collect, use, process, store, and disclose personal information on www.spry.so (the “Website”), the Platform, the App, and in providing our Services generally. We encourage you to occasionally visit this Privacy Policy to review changes we may have made since your last visit. When We Collected Personal Information
We collect personal information when you:
- Use our Platform, App, and Services, including uploading information into our Platform.
- Request a demo of our Platform and Services.
- Sign up for our email newsletter or other communications.
- Register with us.
- Visit our Website.

Types of Personal Information We Collect
Student Athletes:
We collect the following categories of personal information about Student Athletes:
- Personal Details. We may collect personal details such as name, email address, phone number, physical address, and date of birth, or any information Collegiate Administrators request Student Athletes provide.
- Academic Information. For example, we may collect admission status, collect university ID, class schedule, student records, graduating year, grade point average (GPA), academic honors, residency status, and information for name image likeness (NIL) opportunities.
- Recruitment Information. Collegiate Administrators may provide a potential Student Athlete’s commitment status, ratings, recruiting coach, recruiting position,current and former high school, community college, junior college, or college attended, ACT/SAT score, and whether you played with a club and if so, the club name and coach.
- Athletic information. We may collect information such as NCAA eligibility center ID, height, weight, position played, athletic statistics and events, and athletic ratings.
- References and Guardian Information. We may collect the name and contact information of Student Athletes’ guardians and previous coaches.
- Calendar Information. We may collect information in your calendar in order to provide our calendaring/scheduling feature as part of our Product and Services.
- Other Information. We may also collect any other information, documents, photos, or videos uploaded or otherwise provided by a Student Athlete or Collegiate Administrator.
Collegiate Administrators:
We collect the following categories of personal information about Collegiate Administrators:

- Personal Details. We may collect name, email address, phone number, and profile photo.
- Professional Information. We may collect information about Collegiate Administrators such as your title, role, professional email, employer name, employer’s website URL.
- Billing and Financial Information. We may collect financial and payment information such as bank accounts, credit and debit card numbers. Spry does not store this information.
- Calendar Information. We may collect information in your calendar in order to provide our calendaring/scheduling feature as part of our Product and Services.

- Information Uploaded to the Platform. We collect information from documents, photos, and videos you upload to the Platform and Services.
- Messaging Data. When you use our in-Platform messaging feature, we may collect information about correspondents and the content of your messages.
- Form Creation and Submission Data. We may collect information from forms you create, send, and fill out in our Platform.
- Contact Us. We collect information you provide when you contact us, for example when you reach out to customer service, complete a survey/provide feedback, or request a demo.
- Information you Otherwise Provide When Using our Platform or Services.
- Surveys or other market research.
Information We Collect Automatically:
- Metadata and analytics for your use of our Website and Services, including IP address, device information, date/time of visits, new or returning visits, emails or products viewed or interacted with, page response times, URL clickstreams, how long you stay on our pages, what you do on those pages.

- We may use cookies, beacons, pixel tags, and other similar technologies to collect additional information automatically as you interact with the Website and Services and to personalize your experience with our Website and Services. Learn more about our cookie use below.
Sensitive Personal Information:
Some information we may collect may be considered ‘sensitive personal information’ as defined by various U.S. laws. For example, Collegiate Administrators may use the platform to manage Student Athletes’ citizenship, demographics, or health-related information. In addition, we may collect the content of messages sent using the Platform that includes potential information defined as ‘sensitive’.
Children:
We do not intentionally collect any personal information from children under the age of 13. If you believe we have obtained personal information associated with children under the age of 13, please contact us at [email protected] and we will delete it.
How We Use Collected Personal Information
We use the personal information we collect for the following purposes:
- To provide our Website.
- To provide our Platform and Services, including document creation and execution, in-Platform messaging, document management, recruitment activity, roster management, and facility management.
- To communicate with you about any requested information or Services.
- To send you updates and marketing materials.
- To build and improve our Website, Platform, App, and Services.
- To provide customer support.
- For other business purposes such as detecting and preventing fraudulent or illegal activity, complying with applicable law, and maintaining business records.
We may otherwise use personal information with your consent.
Your Rights and How To Exercise Them
You may have the following rights:
- To access the personal information we maintain about you.
- To correct inaccurate information we maintain on you.
- To delete the personal information we have on you. Please note if your personal information is necessary for compliance with our legal or regulatory obligations, then we may retain it.
- To opt out of certain uses of your personal information, namely:
- Email marketing. You can unsubscribe to our email list by clicking the unsubscribe link at the bottom of marketing emails.
- Tailored advertising using third-party cookies. Please refer to our list of advertising services below for company-specific choices, or visit http://optout.aboutads.info to exercise an industry-wide opt-out. In addition, you may reject or delete cookies through your browser settings.

If you are a student whose information was provided to Spry by a Collegiate Administrator, please contact representatives of that college to exercise your privacy rights. Spry is unable to fulfill privacy rights requests for individuals where it acts as a ‘processor’ of personal information on behalf of its customers.
Mobile Privacy
Our App uses software codes provided by our mobile application business partners (software development kits or SDKs) that let our App software interact with the services those partners provide. Sometimes, these interactions involve a business partner collecting information from the device on which the software is run.

On iOS:
- Open the App Store. Go to the Spry App page. Scroll to the App Privacy section. Click See Details.
On Android:
- Open Google Play. Browse or use the search bar to find the App. Click on the App. Under Data Safety, you’ll find a summary of the App’s data safety practices. For more details, tap See Details.
Google API Services
Spry’s use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements. Spry uses Google’s Google API services to allow Collegiate Administrators and Student Athletes to synchronize their calendar events on Spry with their Google Calendar.
Security
We have implemented reasonable security measures designed to protect your personal information from unauthorized access and disclosure. It is important that you understand, however, that no website or online platform is completely secure. We cannot anticipate all potential misuse of your information, and as a result, cannot guarantee the security of any information you transmit to Spry.
Retention
We will retain your personal information for as long as is necessary for the purposes set out in this Privacy Policy or internal policies. The criteria we use to determine retention periods for each category of personal information is based on the type of personal information, contractual requirements, or with regards to product or service maintenance and improvements. We will also retain and use personal information as necessary to comply with our legal obligations, resolve disputes and enforce our legal agreements and policies.

In addition to the rights granted in ‘Your Privacy Choices’ (above), if you are a resident of the above states, you may have the right to:
- Opt out of the ‘sale’ or ‘share’ of your personal information for targeted advertising. We do not ‘sell’ or ‘share’ your personal information for monetary benefit. However, some third-party cookies placed on our Website may be considered a ‘sale’ or ‘share’ under these privacy laws. You may opt out of such cookies as detailed in ‘Use Of Cookies and Tracking Technologies’ section (above).
- Sensitive personal information. We may collect sensitive personal information as detailed in ‘Types of Personal Information We Collect’ section (above). By using our Services, you agree to our collection, processing, and disclosure of sensitive personal information as detailed herein. However, please note that if you are a student whose sensitive personal information was provided to Spry by a Collegiate Administrator, please contact representatives of that college to exercise your privacy rights. Spry is unable to fulfill privacy rights requests for individuals where it acts as a ‘processor’ of personal information on behalf of its customers.

Appeal:
If we deny your privacy request, you may appeal that decision by emailing us at [email protected]. We will respond to your appeal within a reasonable period of time and as required by law. If, after we have processed your appeal, you are still unsatisfied with our response, you have the right to file a complaint with your state attorney general.
Authorized Agents:
If you are an authorized agent submitting a request on behalf of another person, you must provide a copy of a lawful power of attorney or written authorization from the consumer (along with proof of your identity). If you make a request as an authorized agent, you will receive additional instructions. Depending on the type of request, we may contact you or the consumer on whose behalf you claim to act to verify your authorization.
Right to Non-Discrimination:
We do not discriminate against customers who exercise any of their rights described in our privacy policy.
Controller/Processor Designation:
We operate as a ‘controller’ (and a ‘business’ under CCPA) with respect to providing our Website. We operate as a ‘processor’ (and a ‘service provider’ under the CCPA) with respect to providing our Services to our customers.
Changes To This Privacy Policy
We may revise this policy from time to time. You should occasionally review our Privacy Policy so that you keep up-to-date on our most current practices. We will put the effective date of the latest version at the top of each policy. If you are a registered user of our Platform, and we post a material update, we will notify you via email.
